Terms of Service

1. Acceptance of Terms

By accessing or using FireSwap, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

2. Description of Service

FireSwap is a shift trading platform designed to facilitate trade coordination within fire departments and similar organizations. FireSwap provides tools for posting, finding, and completing shift trades directly between members. FireSwap does not replace department policies or collective agreements.

3. User Accounts

By creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your login credentials
  • Notify us immediately of unauthorized access
  • Accept responsibility for activity under your account

You are responsible for ensuring your account information remains accurate.

4. Billing and Subscriptions

FireSwap requires an active paid subscription to use the Service. Pricing varies by billing model:

Pricing

  • Centralized Billing: $1.99 CAD per member per month (department pays for all members)
  • Individual Billing: $2.99 CAD per member per month (each member pays their own subscription)

Subscription Terms

  • Subscriptions are billed monthly
  • Fees are charged in advance
  • Subscriptions renew automatically unless canceled
  • Cancellations take effect at the end of the current billing period

Under centralized billing, the department manager is responsible for managing seat counts. Seat count changes take effect on the next billing cycle. Failure to maintain an active subscription will restrict access to trade functionality. Fees are non-refundable except as required by law.

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes
  • Attempt unauthorized access to systems
  • Submit false or misleading information
  • Interfere with other users' access
  • Attempt to bypass role or permission restrictions

6. Department Policies and Trade Responsibility

FireSwap facilitates shift trade coordination between members but does not override department rules. Users are responsible for ensuring all trades comply with their department's policies, collective agreements, and applicable laws. Official shift approval must follow your department's existing policy—FireSwap is a coordination tool only.

7. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted access. Maintenance, updates, or technical issues may temporarily affect availability.

In the event of system interruptions, users are responsible for maintaining personal records of trade arrangements and should rely on their department's standard trade processes as needed. FireSwap is not responsible for missed trades, scheduling conflicts, or operational issues resulting from service disruptions.

8. No Employment Relationship

FireSwap does not employ users and is not responsible for enforcing employment contracts, collective agreements, or internal department policies.

9. Data Accuracy

FireSwap is not responsible for inaccuracies in user-submitted schedules, trade details, or department data. Users are responsible for reviewing trade information before submission or acceptance.

10. Intellectual Property

All content, branding, and software associated with FireSwap are the property of FireSwap and protected under applicable intellectual property laws.

11. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, FireSwap shall not be liable for indirect, incidental, consequential, or special damages. FireSwap's total liability shall not exceed the total amount paid by the user or department in the twelve (12) months preceding the claim.

12. Termination

We may suspend or terminate accounts for violations of these Terms. Users may delete their accounts at any time. Certain obligations survive termination, including payment obligations and limitation of liability provisions.

13. Governing Law

These Terms are governed by applicable laws in your jurisdiction. Any disputes shall be resolved in accordance with the laws and courts of your country or region of residence.

14. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.
